• Eatfluence acts solely as a Data Processor and processes personal data only on documented instructions from Pikanadas.
• Eatfluence implements reasonable technical and organizational safeguards.
• Eatfluence may use sub-processors for hosting, infrastructure, and messaging services.
• Pikanadas is responsible for responding to consumer privacy requests and maintaining legal compliance.

16. Indemnification

Pikanadas agrees to defend, indemnify, and hold harmless Eatfluence LLC, its officers, members, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Food safety or allergen-related issues
• Order fulfillment, delivery, or refund disputes
• Marketing practices, including SMS or email communications
• Violation of privacy or consumer protection laws
• Payment disputes, chargebacks, or tax obligations

17. Limitation of Liability

To the maximum extent permitted by law, Eatfluence LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption.

In no event shall Eatfluence’s total aggregate liability exceed the total amount paid by Pikanadas to Eatfluence in the twelve (12) months preceding the event giving rise to the claim.
